1. Binding Agreement
By accessing or using RealPosts.ca or any related services (the “Service”), you agree to be legally bound by these Terms.
If you do not agree, you must not use the Service.
2. Nature of the Service
RealPosts provides AI-powered video generation, AI voice modeling, AI likeness modeling, and automated publishing tools.
We are a technology platform only. We are not:

A marketing agency

A broker

A fiduciary

A publisher of record

Responsible for platform compliance
You are solely responsible for all content generated and published through your account.
3. IRREVOCABLE CONTENT LICENSE & MEDIA RIGHTS
This is the key protective section.
By uploading, submitting, recording, transmitting, or otherwise providing any:
- Videos
- Voice recordings
- Audio files
- Images
- Headshots
- Logos
- Branding materials
- Text
- Likeness data
- Biometric identifiers
(“User Media”)
You grant RealPosts Inc. a:
Perpetual, Irrevocable, Worldwide, Royalty-free, Fully paid, Transferable, Sublicensabl, Commercial license
to:
- Use
- Host
- Store
- Reproduce
- Modify
- Edit
- Adapt
- Create derivative works
- Train AI systems
- Generate synthetic voice models
- Generate synthetic likeness models
- Distribute
- Publish
- Display
- Perform
- Promote
- Market
- Improve algorithms
for:
- Operating the Service
- Improving the Service
- Creating derivative AI models
- Internal model training
- Demonstrations and promotional materials
- Business operations
This license survives termination of your account.
You retain ownership of your original media, but RealPosts retains ownership of:
- AI models created
- Derivative synthetic outputs
- System improvements
- Training optimizations
- Platform data structures
4. Biometric & Likeness Consent
By submitting voice recordings or likeness data, you:
- Provide explicit written consent to create synthetic voice and likeness models.
- Waive any right to inspect or approve finished AI-generated outputs.
- Waive claims related to right of publicity, likeness, or voice replication arising from authorized use under these Terms.
You confirm you are:
- The individual represented in the submitted media, OR
- Legally authorized to grant rights on their behalf.
You assume all risk of impersonation disputes.
5. No Expectation of Exclusivity
RealPosts may:
- Develop similar AI models for other users
- Operate in the same market
- Create similar scripts
- Produce similar content themes
You are not granted exclusivity.
6. AI Outputs & Automated Posting
You acknowledge:
- AI-generated content may contain inaccuracies.
- Automated posting may fail, duplicate, misfire, or violate platform rules.
- Social platforms may suspend or ban accounts.
RealPosts is not liable for:
- Platform bans
- Account suspensions
- Shadow bans
- Reduced reach
- Algorithm changes
- Lead loss
- Reputational damage
You assume all publishing risk.
7. User Warranties
You represent and warrant that:
- You own or control all rights to submitted content.
- You are not violating third-party publicity rights.
- You are not impersonating another person.
- You have full authority to grant the license described above.
You agree to provide proof of rights upon request.
8. Indemnification
You agree to defend, indemnify, and hold harmless RealPosts Inc., its officers, directors, contractors, affiliates, employees, and partners from any claims, damages, losses, liabilities, judgments, costs, and expenses (including legal fees) arising out of:
- Your content
- Your likeness disputes
- Your client disputes
- Platform bans
- Misrepresentation
- Advertising violations
- Regulatory violations
- Use of synthetic media
- Claims of defamation
- Copyright infringement
- Publicity rights claims
This obligation survives termination.
9. Limitation of Liability
To the maximum extent permitted by law:
RealPosts shall not be liable for:
- Indirect damages
- Lost profits
- Lost commissions
- Loss of data
- Business interruption
- Reputational harm
- Consequential damages
- Special damages
Total liability under any claim shall not exceed the greater of:
- $500 CAD
OR - The total amount paid by you in the previous 3 months
No class actions permitted.
10. Mandatory Arbitration & Class Action Waiver
All disputes shall be resolved by binding arbitration in [Insert Province], Canada.
You waive any right to participate in:
- Class actions
- Class arbitrations
- Representative actions
11. Account Termination
We may suspend or terminate accounts at our sole discretion, without notice.
Upon termination:
- Access to AI models may be revoked.
- Stored content may be deleted at any time.
- No refunds are owed unless required by law.
